Terms & Conditions of Chargeable

Scope of Application

a) These terms and conditions govern the conditions of rental agreements concluded between the customer (hereinafter referred to as the “User”) and Chargeable (a Powerly Sàrl product hereinafter: “Chargeable”) for the borrowing of mobile batteries for smartphones and other electrical devices (hereinafter “Powerbanks”) at the respective rental location (“venue”). The subject of the rental agreement is the provision of Powerbanks for use by the User.

b) All obligations arising from these terms and conditions towards the User are fulfilled solely by Chargeable and not by the respective venue.

c) The venue acts solely as an intermediary for the services offered by Chargeable in a fiduciary capacity on behalf and for the account of Chargeable.

d) Chargeable reserves the right to make changes to the terms and conditions at any time. The terms and conditions valid at the time of contract conclusion can be accessed at chargeable.ch/terms

e) The most recent version of these terms and conditions applies to each concluded rental agreement.

Object of the Contract

The rental agreement entitles the User to use the Powerbank borrowed from Chargeable for the period of use and, if applicable, for the duration of any delay, and to consume the power charged on the Powerbank.

Registration, Start of Contract, Termination of Contract, Maximum Period of Use

a) To initiate the conclusion of the contract, the User scans the QR code on the Chargeable machine or with their mobile device or taps their credit card against the credit card reader. This redirects them to the Chargeable portal in the browser of their mobile device, where they provide:

Email address; and

Payment method

Through the Chargeable portal, the payment method chosen by the User is then charged. At the time of rental, the User only pays the rent for the agreed period of use. If the payment is successful, the Powerbank is ejected from the machine in a form that allows the User to remove it.

b) The rental agreement between the User and Chargeable is concluded at the moment of payment by the User. Whether the User subsequently retrieves the Powerbank from the machine is irrelevant for the conclusion of the contract.

c) The total rental period duration is a maximum of 3 days (72 hours).

d) The User terminates the rental agreement concluded between Chargeable and the User by returning the Powerbank. To return the Powerbank, the User inserts the rented Powerbank into a free slot of any Chargeable machine. Any Chargeable rental location can be used for the return. An continuously updated overview of the available rental locations can be accessed at chargeable.ch.

Rent and Late Fee

a) The rent agreed between the User and Chargeable for the provision of use during the period of use is CHF 3.00 (including VAT) for the “flash” offer or CHF 5.00 per day.

b) If the User does not return the Powerbank within the period of use, late fees will apply.

The amount of the late fee depends on the time of return.

c) The late fee is CHF 5.00 (including VAT) for each additional 24 hours- upon completion of the 72nd hour the maximum late fee applied is CHF 20.00 (including VAT) ie. the total deposit is kept.

d) The User (excluding damaged Powerbanks) will receive a refund of CHF 15.00 (including VAT) of their deposit upon returning the device within the first 24 hours of the rental start, CHF 10.00 (including VAT) of their deposit if returned between 24 and 48 hours of the rental start, and CHF 5.00 (including VAT) of their deposit if returned between 48 and 72 hours of the rental start. After 72 hours, the total and maximum rental amount (rent for the agreed period of use + late fee) is CHF 20.00 (including VAT).

Deposit

a) After the 4th day (from the start of the 97th hour), CHF 20.00 will be kept (ie. total deposit). The amount will be blocked by preauthorization, if possible, by the payment method chosen by the User.

b) The deposit will be fully refunded or released to the User when the User returns the Powerbank undamaged to Chargeable within the agreed period of use. If the User returns the Powerbank late, the deposit will be offset against the late fee then due. The return of the deposit generally occurs through the payment method used by the Customer when concluding the contract.

Transfer of Ownership to the User

If the User does not return the Powerbank within 72 hours after the agreed period of use, ownership of the Powerbank transfers to the User. The deposit will then be fully retained by Chargeable as the purchase price. Chargeable will remit VAT on the retained deposit. The rental agreement is then considered terminated.

Additional Information:

a) When the User wishes to terminate the rental agreement, they will visit any Chargeable Venue with an available slot. The available locations can be viewed anytime at https://www.chargeable.ch. On-site, the User inserts the Powerbank into the free slot of the machine. Afterwards, the User will submit to Chargeable via the form at https://chargeable.ch/return the rental location, rental time, return location and return time, as well as a payment connection to Chargeable. Chargeable will then refund the deposit minus any applicable late fees within 10 days.

Misuse of the Powerbank

The Powerbank of Chargeable AG is designed solely for charging electrically operated mobile devices. Use for other purposes is prohibited to the User.

Warranty

a) If the Powerbank has a defect, this must be reported immediately by the User after rental. In this regard, the User is obliged to check the Powerbank immediately upon receipt. If the Powerbank taken by the User is defective, they want to initiate a new borrowing process and report the defective device.

b) The complaint is handled by Chargeable’s support. This can be reached via email at info@chargeable.ch. The costs for the complained device will be refunded to the User by Chargeable.
